Mediation is a commonly used alternative dispute resolution (ADR) process in Texas. Mediation is a voluntary process where the parties to a dispute allow a mediator to help them create their own solution to settling their conflict. The mediator acts as a neutral facilitator helping all of the parties focus on the real issues where they can brainstorm options for settlement and arriving at a solution that is beneficial and workable to all the parties.
A bilingual mediator is important and necessary in order to allow Spanish speaking parties to truly understand the process and their choices. Understanding is at the very foundation of what is needed at mediation, and having a mediator that can effectively speak to your Spanish speaking clients will help everyone come to a mutually beneficial decision.
Mediation offers parties an opportunity to resolve their disputes outside of a courtroom, often resulting in more efficient and cost-effective solutions. Here is an overview of the mediation process in Texas:
Peace is not the absence of conflict, but the ability to cope with it. – Ghandi
It is important to note that mediation is often voluntary, and parties are not forced to reach an agreement. However, the collaborative nature of mediation and the potential for creative problem-solving make it an attractive option for resolving disputes in Texas. Additionally, many Texas courts encourage and even require parties to attempt mediation before proceeding to trial as a way to alleviate court congestion and promote the efficient resolution of cases.
